1. Agreement to Terms
By accessing rhp-group.com, submitting our contact form, or engaging RHP Group LLC ("RHP Group," "we," "us," or "our") for services, you ("Client") agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.
2. Services
RHP Group provides done-for-you motivated seller lead generation services for real estate wholesalers and investors. Services include targeted homeowner list sourcing, power dialing campaigns via offshore virtual assistants, quality assurance review of calls, and delivery of pre-vetted motivated seller leads. The specific scope, volume, and pricing of services are as agreed upon between RHP Group and Client at the time of engagement.
3. Payment Terms
Services are billed at the agreed rate (currently $1,300 per VA per month) on a recurring monthly basis. Payment is due at the start of each billing cycle. RHP Group reserves the right to pause or terminate services if payment is not received within 5 business days of the due date. All fees are non-refundable unless otherwise agreed in writing. RHP Group reserves the right to adjust pricing with 30 days written notice to the Client.
4. No Guarantee of Results
RHP Group does not guarantee any specific number of leads, conversion rates, closed deals, or revenue outcomes. Lead generation is subject to market conditions, list quality, homeowner responsiveness, and factors outside our control. We commit to delivering the agreed service scope with professional quality and consistent effort, but make no warranties regarding financial results.
5. Client Responsibilities
Client agrees to: maintain a valid and lawfully operating real estate business; use all leads delivered by RHP Group in full compliance with applicable federal, state, and local laws including but not limited to the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry rules, and all real estate licensing requirements; provide accurate business information when engaging our services; respond to delivered leads in a timely manner; and not resell, redistribute, or share leads delivered by RHP Group with any third party without prior written consent.
6. Prohibited Uses
Client may not use RHP Group's services or delivered leads to: engage in fraudulent, deceptive, or misleading practices toward homeowners; violate any applicable federal, state, or local law or regulation; harass, threaten, or abuse homeowners or any other individuals; contact individuals on the National Do Not Call Registry outside of legally permitted exemptions; or infringe upon the intellectual property, privacy, or other rights of any third party.
7. Intellectual Property
All systems, processes, dialing scripts, training materials, workflows, and proprietary methodologies used or developed by RHP Group remain the exclusive intellectual property of RHP Group LLC. Client receives no license or ownership rights to any RHP Group systems or processes. Lead data delivered to Client is for Client's own business use only and may not be resold or sublicensed.
8. Confidentiality
Both parties agree to keep confidential any proprietary business information, pricing, processes, or client data shared during the engagement. This obligation survives termination of the agreement.
9. Data Privacy and No Third-Party Sharing
RHP Group does not share, sell, rent, or trade any client or contact information with any third parties for any purpose. No mobile opt-in data, phone numbers, SMS consent records, or any personal information collected through our website or services will be shared with any third parties under any circumstances. The only exception is when legally compelled by law, court order, or subpoena, in which case only the minimum required information will be disclosed.
10. Limitation of Liability
To the maximum extent permitted by applicable law, RHP Group's total liability to Client for any claims arising out of or related to these Terms or the services provided shall not exceed the total amount paid by Client to RHP Group in the 30 days preceding the claim. RHP Group shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost deals, even if advised of the possibility of such damages.
11. Indemnification
Client agrees to indemnify, defend, and hold harmless RHP Group LLC, its members, managers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses including reasonable legal fees arising out of or related to Client's use of delivered leads, Client's violation of these Terms, Client's violation of any applicable law, or any claim by a third party arising from Client's business activities.
12. Termination
Either party may terminate services with 30 days written notice. RHP Group may terminate immediately and without notice if Client violates these Terms, engages in illegal activity, or fails to make payment. Upon termination, Client's access to ongoing services ceases and no refunds are issued for the current billing period. Any outstanding balances remain due and payable.
13. SMS Communications
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from RHP GROUP LLC. This includes SMS messages for account notifications, customer care, marketing. Message frequency varies. Message and data rates may apply. See privacy policy at https://rhp-group.com/privacy-policy. Message HELP for help. Reply STOP to any message to opt out.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ohio.
15. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Ohio under the rules of the American Arbitration Association. Each party bears its own legal fees unless the arbitrator awards otherwise.
16. Modifications
RHP Group reserves the right to update these Terms of Service at any time. Updated terms will be posted at rhp-group.com/terms-of-service with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between RHP Group LLC and Client regarding the subject matter herein and supersede all prior agreements, representations, or understandings, whether written or oral.
